Postman Workshop Terms of Use

Effective Date: July 15th, 2024

By accepting this agreement, either by clicking a box indicating your acceptance or by executing an order form that references this agreement, or by using or accessing Postman training material, you agree to be bound by the terms of this agreement.

1. Scope of Training. The training workshop is designed to build competency effectively in API prototyping, testing and documentation using Postman. The content covered in the workshop is standardized for all customers and not tailored to your specific business problems or scenarios. The workshop exclusively functions within a demo environment and does not interface with your operational environment. You may choose a face-to-face or a virtual training option based on the preferences and needs of your organization.

2. Fee and Scheduling. To register for the training workshop, please sign up or reach out to your account team. Upon receipt of your request, we will promptly assist you in scheduling a session with one of our experienced trainers. You will have the flexibility to choose a convenient time for the training session based on your availability and the availability of our trainers. You are responsible for paying all fees for the training. If you need to reschedule your training session, we understand that circumstances may change. You are welcome to request a rescheduling up to 30 days prior to an in-person workshop and two weeks prior to a virtual workshop. While we do not offer refunds, we are committed to working with you in good faith to reschedule any affected arrangements. Please note that while we strive to accommodate your preferred schedule, we cannot guarantee availability. Rescheduling requests for in-person workshops, held a few times a year, will be accommodated based on availability. If you would like to inquire about our current availability or discuss scheduling options, please don't hesitate to reach out to our team.

3. Materials and Ownership. You are granted a limited, non-exclusive, non-transferable license to use these materials solely for internal purposes. Materials provided during the training workshop, including presentations, documents, and resources, are the intellectual property of Postman. Recording, reproduction, distribution, or sharing of workshop materials outside of the participant's organization is strictly prohibited without the prior written consent from Postman. You agree to maintain the confidentiality of any proprietary information disclosed during the training workshop. This includes, but is not limited to product roadmap details, pricing structures, and any other sensitive information shared by Postman representatives. We look forward to receiving your comments, requests and other feedback regarding the workshop and you agree that we are free to incorporate and use your feedback without restriction of any kind.

4. Conduct and Etiquette. You are expected to engage in respectful and professional conduct throughout the training workshop, and must comply with our Code of Conduct (available at https://www.postman.com/legal/events-code-of-conduct/). The decision to remove a participant or cancel their participation rests solely with Postman. You are required to adhere to all health and safety regulations during the training workshop, whether it is conducted face-to-face or virtually. This includes but is not limited to following instructions provided by the trainer and maintaining a safe environment for themselves and others. Sharing of login credentials or allowing non-registered guests to join the training session is strictly prohibited. Each participant must register individually, and access to the workshop is limited to registered participants only. Ticket reselling is not permitted.

5. Limitation of Liability. We strive to deliver high-quality training content and resources, but Postman cannot guarantee the accuracy, completeness, or suitability of the information provided. In no event shall Postman be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use or performance of the training workshop or the materials provided. Our entire liability to you arising out of or related to these terms shall not exceed the amount actually paid by you to us for the service during the prior twelve (12) months under these terms.

6. General Terms. This Agreement shall be governed by and construed in accordance with the laws of the State of California, without application of its conflicts of laws principles. Any legal proceeding arising out of or relating to this Agreement will be brought in the state and federal courts of San Francisco County, California. Each Party consents to the exclusive jurisdiction and venue of such courts. Neither Party will be liable for any delay or default in its performance of any obligation under the Agreement (other than a payment obligation) caused directly or indirectly by fire, flood, act of God, acts of government, an act or omission of civil or military authority of a state or nation, strike, lockout or other labor problem, inability to secure, delay in securing or shortage of, labor, materials, supplies, transportation or energy, failures of suppliers, or by war, riot, pandemic, embargo or civil disturbance, breakdown, or destruction of plant or equipment arising from any cause whatsoever, or any cause or causes beyond such Party's reasonable control (collectively, “Force Majeure Events”). Registrant data will be handled in accordance with the Postman Privacy Policy. This Agreement reflects the exclusive and entire understanding between the Parties relative to the subject matter hereof and may not be modified except by another written agreement, signed by both Parties. Any notice required or permitted under this Agreement shall be made in writing and deemed delivered upon verification of delivery to the other Party's legal department; in addition, a courtesy copy of all notices will be sent via email of even date to legal@postman.com.
